Judge Gary R. Brown of the U.S. District Court for the Eastern District of New York issued the scathing reprimand Monday, condemning the agents’ actions when they apparently misidentified a pair of men they arrested in New York City earlier this year — then allegedly covered their tracks by falsifying official paperwork.

The petitioner, Angel Jesus Almonte, a 26-year-old undocumented immigrant, alleges ICE agents arrested him based on a physical description despite the fact that he’s five inches shorter and 80 pounds lighter than their intended target, the filing says.

During cross-examination, the ICE team leader acknowledged, “It’s very easy to see they’re two different people.”

Following the arrest, Brown determined that the paperwork filed by agents contained false information, as did testimony provided by the officials.

The case stems from a May 6 ICE operation in which three officers were involved: team leader John Katepodis, deportation officer Kevin Brodowsky and deportation officer Zamir Yassin, all relatively new to their jobs, Brown wrote.

    If you look “foreign” (i.e. brown skin), the secret police will kidnap you, shoot your dog, and then falsify paperwork to get you deported to a country you’ve never been in.

    This is one of the darkest times in our nations history.
